This license applies to the registered version of epcEdit (the software).
You should carefully read the following terms and conditions before using the software. Unless you have a different license agreement signed by Koch & Halstenberg GbR., your use of this software indicates your acceptance of this license agreement and warranty.
General. The software and any documentation accompanying this License whether on disc, on any other media or in any other form are licensed, not sold, to you by Koch & Halstenberg GbR. for use only under the terms of this License, and Koch & Halstenberg GbR. reserves all rights not expressively granted to you. The rights granted herein are limited to Koch & Halstenberg GbR's intellectual property rights and do not include any other patents or intellectual property rights.
Certain components of the software have been or may be made available by Koch & Halstenberg GbR as Open Source. You may modify or replace only these Open-Sourced Components; provided that you comply with the terms of this License and any applicable licensing terms governing use of the Open-Sourced Components. Koch & Halstenberg GbR is not obligated to provide any maintenance, technical or other support for the resultant software.
Evaluation License. Koch & Halstenberg GbR offers evaluation licenses of the software to assess the performance of the software. You may obtain an evaluation license for the software only once and only for the purpose of testing the software. Evaluation licenses are only valid for a limited period of time and are not renewable. After the evaluation period has expired, you must obtain a full license or cease to use the software.
Single User License. One registered copy of the software may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used nonsimultaneously by multiple people, but not both.
You may access the software through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if different workstations will access the software on the network, each workstation must have its own license, regardless of whether they use the software at different times or concurrently.
Multiple User License. If you have purchased a multiple user license of the software, you may install the software on any compatible computers, provided that only the permitted number of users actually use the software at the same time.

Company License. If you have purchased a company license of the software, you may install the software on an unlimited number of compatible computers in your company, regardless of location, but owned by the company. An unlimited number of employees of the company may use the software at the same time.
Activation Keys. You will receive an activation key when you elect to purchase the software. The activation key will enable you to activate the software after an initial sixty (60)-day evaluation period. You may not relicense, reproduce or distribute an activation key except with the express written permission of Koch & Halstenberg GbR.
Academic and private use licenses. Koch & Halstenberg GbR offers special discounts for the use of the software for non-commercial purposes. You may obtain an academic and private use license for the software if and only if the software is going to be used for strictly non-commercial purposes. Only the use of the software for academic, educational, private and hobbyist purposes is considered non-commercial.
Transfer. You may not rent, lease, lend, redistribute, or sublicense the software. You may, however, make a one-time permanent transfer of all of your license rights to the software to another party, provided that: (a) the transfer must include all of the software, including all it's component parts, printed materials, the activation key and this License; (b) you do not retain any copy of the activation key; (c) the party receiving the software reads and agrees to accept the terms and conditions of this License.
Termination. This License is effective until terminated. Your rights under this License will terminate automatically without notice from Koch & Halstenberg GbR if you fail to comply with any terms of this License. Upon the termination of this License, you shall cease all use of the software and destroy all copies, full or partial, of the software.
Governing Law. This agreement shall be governed by the laws of the Federal Republic of Germany. If for any reason a court of competent jurisdiction find any provision, or portion thereof, to be unenforceable, the remainder of the License shall continue in full force and effect.
Third Party Acknowledgments. Portions of the software utilize or include third party software and other copyrighted material. Acknowledgments, licensing terms and disclaimers for such material are contained in the online electronic documentation for the software, and your use of such material is governed by their respective terms.
Disclaimer of Warranty. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE LICENSED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which the software may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
In no event unless required by applicable law or agreed to in writing will Koch & Halstenberg GbR, its employees, contractors or the authors of the accompanying documentation, be liable for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the program to operate with any other programs), even if advised of the possibility of such damages.
THE SOFTWARE IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION, COMMUNICATION SYSTEMS OR AIR TRAFFIC CONTROL EQUIPMENT, WHERE THE FAILURE OF THE SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. ANY LIABILITY OF THE LICENSOR WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
